Agreement to Terms

By accessing or using Element Event Rentals' ("we," "our," or "us") website and services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

Quotes & Agreement

All quotes are valid for a limited time as specified on the quote and are subject to change. A signed rental agreement and the required initial payment must be received to reserve rental items and services.

All rental items remain the exclusive property of Element Event Rentals. Customer is responsible for the care and timely return of all items. Failure to return items upon expiration of the rental period or pay all amounts due may be considered evidence of intent to defraud under Florida Statutes Section 812.155.

Payments and Deposits

A non-refundable deposit, as specified in your rental agreement, is required to confirm your reservation. Final payment is due by the date outlined in your agreement. We accept payments via Zelle and credit card. 

Delivery and Pickup

Delivery and pickup are available within designated service areas for a fee based on distance. Customer must ensure the event site is accessible and provides adequate, safe space for setup. All rental items must be consolidated and ready for pickup at the pre-arranged time. Additional fees may apply for after-hours service or customer-caused delays.

Customer’s Responsibility for Damage and Loss

While normal wear and tear is expected, the Customer is financially responsible for all other damage, loss, or theft of rented items. Damaged or lost items will be charged at their full replacement cost. A cleaning fee will be assessed if items are returned excessively dirty, as detailed in the rental agreement.

Weather Policy

Customer assumes all risks associated with weather for outdoor events, and we strongly recommend a contingency plan. Deposits remain non-refundable in the event of weather-related cancellations. For safety, we reserve the right to delay or postpone setup or takedown during severe weather warnings.

Liability

Customer agrees to indemnify, defend, and hold harmless Element Event Rentals from any claims, damages, and expenses arising from the use or possession of the rental equipment. We are not liable for injuries or damages caused by equipment misuse or unforeseen site conditions. In no event shall our total liability exceed the total rental fees paid by you under the applicable agreement.

Use of Website

When using our website, you agree to: provide accurate information when requesting quotes; not use the website for any unlawful purpose; and not attempt to gain unauthorized access to our systems.

Intellectual Property

All content on this website, including text, graphics, logos, images, and the like, is the property of Element Event Rentals and is protected by applicable laws. Unauthorized use is prohibited.

Changes to Terms

We reserve the right to modify these terms at any time. Changes will be effective immediately upon posting to the website. Your continued use of our services constitutes acceptance of the modified terms.

Governing Law

These Terms of Service shall be governed by the laws of the State of Florida. Any legal suit, action, or proceeding arising out of these terms shall be instituted in the federal or state courts located in Hillsborough County, Florida.
